IV.1.1)Type of procedure
Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below
• The works, supplies or services can be provided only by a particular economic operator for the following reason:
o absence of competition for technical reasons
Explanation:
The Fast Air Support Team (FAST) Project Team, as part of the UK Ministry of Defence (“MoD”), intends to award a contract to Enterprise Services, Defence & Security UK Ltd for the procurement of a version 7 (v 7) upgrade to the Advanced Mission Planning Aid (“AMPA”) Operating System particular to Typhoon aircraft known as TyAMPA to meet the modification to the Typhon aircraft at Phase 3 Enhancement (P3E) standard. This requirement will deliver enhancements to the UK AMPA functionality.
It is considered that a new contract will be awarded using the negotiated procedure without prior publication of a contract notice in accordance with Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contract Regulations 2011) for technical reasons. This is because only Enterprise Services, Defence & Security UK Ltd has the requisite knowledge in relation to this equipment to meet the requirement. The upgrade of TyAMPA to v 7 to support the P3E standard of aircraft is a key capability enabler to meet the stated objectives, and the Ministry of Defence needs to use the same Mission Planning System to ensure interoperability for operational purposes.
